Rental Agreement

Upon booking and completing payment, guests agree to the following:​

RESERVATION POLICIES AND IMPORTANT DETAILS TO KNOW:

Cancellation:  Full payment including applicable taxes and fees is due at booking.  Full refunds, less any non-refundable deposit, will only be given if cancellation occurs at least 60 days prior to check-in date.   We are sorry for this strict policy, but we are a small family owned resort and the booking season is short.

Booking & Capacity: The guest booking the reservation must be at least 18 years of age and must be one of the guests staying on the property for the duration of the reservation. Five persons maximum per cottage.

Contactless check-in: We provide contactless check-in. Ahead of arrival, we will send a cottage lock code to the email address provided at the time of booking. Guest may arrive between 4 p.m. and 11 p.m. on their check-in date. If you wish to arrive outside of this time period, please contact us in advance with your request and we will do our best to accommodate you.

Check-out: Check-out time is 10 a.m. Before check-out, guests must wash dishes, remove all items from the refrigerator & freezer, and dispose of trash in the dumpster near the main road.  Please let us know if something gets damaged or isn't working properly so we can make it right for you and the next guest (we understand accidents happen and there is wear and tear). Management is not responsible for lost or stolen items.

Quiet time:  Please be considerate of other guests and our neighbors at all times, but quiet hours are from 11p.m. - 8 a.m.

 

Pet Policy:  Pets are only permitted in designated cottages and must be declared at booking and pet fees must be paid at time of booking. Maximum two well-behaved, housebroken pets who are up-to-date on vaccinations and free of fleas and ticks are allowed per cottage. Pets are permitted in designated cottages only (cottages1, 2, 3, 12, 13, and 14). Pets are strictly prohibited in all other cottages. Dogs must be on a maximum six-foot leash at ALL times while outside the cottage, and are not permitted to be tied up anywhere on the property. Pets may not be left unattended in the cottage for more than two hours, and are required to be securely contained in a carrier/crate while they are unattended in the cottage. Guests are responsible for bringing their own carriers.  Dog owners must immediately pick up excrement and dispose of in the dumpster. Pet owners must have full control of their animals at all times. If pets become a nuisance or danger (e.g. excessive barking, aggressive behavior, or damage), the resort reserves the right to expel the pet without any refund of any kind. Guests are responsible for all liability and damages  suffered as a a result of their pet(s). Blue Haven Beach Resort reserves the right to charge guest's account commesurate to the cost of damages. Failure to comply with the pet policy may result in eviction without a refund of any kind or amount.

Supplies: Please remember to bring your own bath towels, toiletries, and beach towels. We will provide bed sheets, pillows, and bed linens.  Each cottage has a kitchen with stove and oven, refrigerator, microwave, coffeemaker, toaster, dishes, basic pots and pans, and silverware. Bedrooms have one double bed and one twin bed, or a small futon. Living areas have one full size futon or sleeper sofa, and dining table and chairs. Covered porch facing the lake has two chairs and a charcoal grill. Picnic tables, beach chairs, and fire pits are available on the property for your use. All linens and furniture provided are to remain inside the cottage.

Fire Safety: Fires are permitted in the provided fire rings only. Extinguish fires with water, not sand. Children must be supervised near firepits. One outdoor charcoal grill per cottage is provided for guest use. Guests are responsible for providing charcoal, lighters, proper grilling utensils, and for operating the grill a 10-foot-distance from buildings and combustible materials. Guests are responsbilbe for cleaning the grill after usage, including disposing of cooled ashes, grease, and debris.  No frying (e.g. bacon, deep frying in oil) is permitted inside the cottage due to fire hazard, disposal of fats, and potential of lingering odors. Do not leave cooking food unattended. Fire extinguishers are provided in each cottage. Fireworks or other explosives are not permitted on the property, including the beach.

No smoking/vaping of any kind in any cottage or a minimum $250.00 fee will be charged for cleaning and deodorizing. If you smoke outdoors, please be considerate and refrain from smoking near other guests. Guests are responsible for immediately and safely disposing of smoking materials.

The Fine Print (you are the “Guest”, we are the “Owner”): ​

This Agreement applies to all members of the Guest's party no matter the age or affiliation. Guest acknowledges that Guest is responsible for sharing the renter agreement, and its requirements, with all members of the Guest's party and anyone else permitted onto the Rental Property by the Guest. 

Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property or are in violation of any rules or policies. Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair.

No refunds will be given due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by county or local officials due to potentially dangerous situations arising from acts of god or nature. 

In the event Owner is unable to make Rental Property available for any reason other than described above or a reasonable substitute as determined by Owner, Guest agrees that Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability. Guest also agrees to indemnify Owner from and against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the kitchen, shower, outdoor area, beachfront, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner. 

Owner may terminate this Agreement upon the breach of any of the terms hereof by Guest. Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately. 

Agreement shall be enforced under the laws of the state of Michigan, and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in Oakland County, Michigan. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement. 

The Rental Property may offer access to recreational and water activities, including but not limited to canoes, bicycles, and swimming. Guest fully understands and acknowledges that outdoor recreational and water activities have inherent risks, dangers and hazards. Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guest hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person. Guest hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Owner and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise howsoever rising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not, including use of Rental Property facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he/she may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons. ​

By completing booking and remitting payment, you, the Guest, agree to the terms and conditions above.
