Rental Agreement
Blue Haven Beach Resort - 2779 S. US 23 Greenbush, MI

Upon booking and completing payment, guests agree to the following:​

RESERVATION POLICIES AND RULES:

 

Payment/Cancellation:  Full payment, including applicable taxes and fees, is due at booking.  Full refunds will only be given if cancellation occurs at least 60 days prior to check-in date.

Rental Term:  From June 24, 2023 to August 26, 2023, only Saturday to Saturday weekly rentals are permitted.  All other dates, there is a three night minimum.

 

Check-in/Check-out: We provide contactless check-in. Ahead of arrival, we will send a cottage lock code to the email address provided at the time of booking. Guests may arrive between 4 p.m. and 11p.m on their check-in date. If you wish to arrive outside of this time period, please contact us in advance with your request and we will attempt to accommodate you. Check-out time is 10 a.m.

Capacity: Five persons maximum per cottage. The guest booking the reservation must be over the age of 18 and assume responsibility for any guests in their party under the age of 18.

Cleaning: $75.00 cleaning fee per cabin will be charged with each reservation. Please leave the cottage  in at least as good condition as when you arrived, including washing all dishes, emptying and disposing of food, removing bed linens and disposing of trash in the dumpster near the road. If we determine, in our opinion, that unit is left exceptionally messy or damage occurs to the unit, we reserve the right to charge the following additional fees: excess cleaning fee, trash removal fee, missing item replacement costs, damaged item replacement or repair costs, repair costs of buildings or grounds, or other service call fees. 

 

Pets: We know you love all your pets, but only dogs are permitted at Blue Haven, if they (and you) follow the rules.  A maximum of two dogs are allowed per cottage. Dogs are permitted in designated cottages only (#14,13,12,1,2,3). All dogs must be declared and fees paid at the time of booking.  Dogs must be on a maximum six foot leash at ALL times and are not permitted to be tied up anywhere on the property.  Dogs are not allowed on furniture or beds.  Dog owners must immediately pick up excrement and dispose of it in the dumpster.  You must have full control of your animal(s) at all times.  If pets become a nuisance or danger, or there is a failure to comply with the pet policy, we reserve the right to expel the pet without any refund of any kind or amount.

Smoking: No smoking/vaping of any kind is allowed in any cottage. Failure to comply will result in a $250.00 fee being charged for cleaning and deodorizing. Leave ashtrays outside on the porch, do not empty into the cottage trash as it is a fire hazard.

Supplies: Please remember to bring your own bath towels, toiletries, and beach towels.  We will provide bed linens and pillows. All linens and furniture provided in the cottage are to remain inside the cottage. Items supplied by the resort are not to be used on the beach.

 

Kitchen/Baths: Basic kitchenware is provided. If something appears to be broken or missing, please notify us right away. We will make every reasonable effort to assure that any appliances and  utilities will be and remain in good working order. No grease, coffee grounds, or food refuse in any drain. Use the trash bags and cans provided. No frying bacon or deep frying inside the cabins. Put only toilet paper in the toilet in small amounts. 

 

Fire Pits: Fires are permitted in the provided fire rings only. Wood is available for a small fee. Extinguish fires with water, not sand, so it is ready for the next person.

Beach: Please enjoy the large private beach on our property, but be mindful that we have neighbors on both sides and stay off of their property. No glass is permitted on the beach. 

 

Noise: Please be considerate of other guests and our neighbors. Quiet hours are 11 p.m. - 8 a.m. 

 

Fireworks: Fireworks and other explosives are not permitted on the property.

Management is not responsible for lost or stolen items. No criminal activity will be tolerated in the cottages or on the property. All Federal, State and County laws and regulations remain applicable, even on vacation, and we expect you will follow them.

 

Legal stuff our lawyer said we needed (you are the “Guest”, we are the “Owner”): ​

This Agreement applies to all members of the Guest's party no matter the age or affiliation. Guest acknowledges that Guest is responsible for sharing the renter agreement, and its requirements, with all members of the Guest's party and anyone else permitted onto the Rental Property by the Guest. 

 

Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property or are in violation of any rules or policies. Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair.

 

No refunds will be given due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by county or local officials due to potentially dangerous situations arising from acts of god or nature. 

 

In the event Owner is unable to make Rental Property available for any reason other than described above or a reasonable substitute as determined by Owner, Guest agrees that Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability. Guest also agrees to indemnify Owner from and against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the kitchen, shower, outdoor area, beachfront, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner. 

 

Owner may terminate this Agreement upon the breach of any of the terms hereof by Guest. Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately. 

 

Agreement shall be enforced under the laws of the state of Michigan, and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in Oakland County, Michigan. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement. 

 

The Rental Property may offer access to recreational and water activities, including but not limited to canoes, bicycles, and swimming. Guest fully understands and acknowledges that outdoor recreational and water activities have inherent risks, dangers and hazards. Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guest hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person. Guest hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Owner and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise howsoever rising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not, including use of Rental Property facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he/she may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons.

By completing booking and remitting payment, you, the Guest, agree to the terms and conditions above.
